Terms of Service

These terms govern your use of Aum (“the app”), published by Alpha Intel Labs (“we”, “us”). By installing or using Aum you agree to them. If you don't agree, don't use the app.

1. What Aum Is

Aum is a relaxation and meditation aid. It synthesises tones, rhythmic pulses, ambient soundscapes and haptic vibration on your device, and provides a visual and audible breathing guide. It is intended for general wellbeing, relaxation, focus and sleep support.

Aum is not a medical device. It is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition, and it has not been evaluated or approved by the FDA, the MHRA, the EMA or any other regulatory authority. Nothing in the app, on this website, or in any associated store listing is medical, psychological or therapeutic advice.

2. Health and Safety

Read this section before using the app. It is the most important part of these terms.

Seizure disorders

If you have epilepsy, a history of seizures, or any photosensitive or audiogenic seizure disorder, consult a qualified doctor before using Aum. Every session in the app includes rhythmic auditory stimulation, and some include a pulsing visual guide. Rhythmic sensory stimulation is a recognised seizure trigger in susceptible individuals. Stop using the app immediately and seek medical attention if you experience dizziness, altered vision, eye or muscle twitching, disorientation, involuntary movement, or loss of awareness.

Do not use while driving

Do not use Aum while driving, cycling, operating machinery, or doing anything else where reduced alertness could cause harm. The sleep and deep-rest programs are specifically designed to induce drowsiness and they are effective.

Talk to a clinician first if

• you are pregnant;
• you have a pacemaker, cochlear implant, or other implanted or wearable medical device;
• you have a heart condition, or a neurological or psychiatric condition — including but not limited to arrhythmia, migraine with aura, tinnitus, vertigo, PTSD or a dissociative disorder;
• you are being treated for any condition that could be affected by relaxation, altered breathing or altered alertness.

Breathing exercises

The breathing patterns in Aum involve slowed breathing and, in some patterns, breath holds. Never practise breath holding in or near water. Stop immediately if you feel light-headed, dizzy, short of breath, or anxious, and return to normal breathing. If you have asthma, COPD, or any other respiratory condition, speak to your doctor before using paced breathing.

Hearing

Prolonged listening at high volume can permanently damage your hearing, regardless of the frequency being played. Use the lowest volume at which the session is comfortable. Aum recommends headphones for the binaural layer; this makes volume discipline more important, not less.

Stop if it doesn't feel right

Discontinue use if you experience headache, nausea, ear discomfort, anxiety, agitation or any other adverse effect, and consult a healthcare professional if it persists.

3. Claims, Evidence and Tradition

Aum draws on the Solfeggio frequency tradition and on related tuning traditions. The therapeutic claims attached to those frequencies by tradition are not supported by clinical evidence, and we do not make them. The app quotes those claims where they are historically relevant, attributes them, and corrects them in the same place — for example, 528 Hz is widely described as repairing DNA; that claim originates in a 1990s book, not in any laboratory result.

The app labels each of its layers with an evidence tier — researched, emerging or traditional — and shows that labelling to you in a dedicated screen. Those tiers describe the general state of published research into a practice, not a prediction about you. Slow paced breathing at around six breaths per minute has the best supporting evidence of anything in the app; the specific frequencies have none. No outcome is promised, and individual responses vary widely.

4. Purchases and Refunds

Aum is free to install and includes a limited set of sessions at no cost. The complete app is unlocked by a single one-time purchase. It is not a subscription and does not recur.

The trial. When you install Aum, the complete app is open to you for five full sessions, to be used within thirty days of installing. A session counts against those five only if it needed the trial — the sessions that are free for everyone never use one. The trial is not a subscription: nothing is charged when it ends, and nothing renews. When it does end, the free sessions remain available for as long as you keep the app.

When a session counts. A session counts once you have listened to 40% of it, or four minutes, whichever comes first. Stopping before that costs you nothing, so opening something to hear what it is and backing out is free. A session that is still playing when the app closes counts for the time it played.

Ambience and single tones have no set length of their own. During the trial they run for ten minutes and count as one session, under the same rule as everything else — stopping inside the first four minutes costs you nothing. Starting one again counts as another session. Once the app is unlocked they play until you stop them.

Continuous Play is part of the full app and is not included in the trial. With it turned on, a session starts again when it reaches its end instead of stopping.

All payments are processed by the app store you installed from, under that store's terms. Prices are set and displayed by the store in your local currency and may vary by region or change over time; the price shown at checkout is the price that applies.

Refunds are handled by the app store, not by us, according to its refund policy. We cannot issue, reverse or expedite a store refund. Your purchase is tied to the store account you bought it with and can be restored on your other devices through that account.

We may change what the free tier includes for future installs. We will not remove content you have already paid for.

5. Licence

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use Aum on devices you own or control, for your own personal, non-commercial use.

You may not:

• copy, redistribute, resell, rent, sublicense or publish the app or its audio engine;
• reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it despite this restriction;
• circumvent, disable or interfere with the purchase or entitlement mechanism;
• use the app or its output in a commercial setting — including therapeutic, clinical or client-facing practice — without our written permission;
• remove or obscure any proprietary notice.

All intellectual property in the app, including its synthesis engine, program designs, written copy, artwork and name, remains ours. These terms grant no trademark rights.

6. Availability and Changes

We may update, change or discontinue Aum or any of its features. We may release updates that add, alter or remove functionality. We are not obliged to maintain compatibility with every operating system version indefinitely. Because the app runs entirely on your device, an installed copy continues to work whether or not we publish anything further.

7. Disclaimer of Warranties

To the fullest extent permitted by law, Aum is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that it will work on every device, or that it will produce any particular result, effect or benefit.

8. Limitation of Liability

To the fullest extent permitted by law, Alpha Intel Labs will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or relating to your use of or inability to use Aum, whether based in contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to Aum or these terms will not exceed the greater of the amount you actually paid for the app or USD $25.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including, in some jurisdictions, liability for death or personal injury caused by negligence, for fraud, or under non-excludable consumer guarantees. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so some of the above may not apply to you. You may have rights under local consumer law that these terms do not affect.

9. Indemnity

You agree to indemnify and hold harmless Alpha Intel Labs from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of the app, your breach of these terms, or your violation of any law or the rights of a third party.

10. Privacy

Aum collects nothing and has no server. What the app stores locally, and why, is set out in our Privacy Policy, which forms part of these terms.

11. Termination

These terms apply for as long as you use Aum. You may end them at any time by uninstalling the app. We may terminate your licence if you materially breach these terms. Sections 3 and 7 through 12 survive termination.

12. General

If any provision of these terms is held unenforceable, the rest remains in force and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. These terms are the entire agreement between you and us regarding Aum, and supersede any earlier version. You may not assign them; we may assign them in connection with a merger, acquisition or sale of assets.

We may revise these terms. Material changes will be reflected in the date at the top of this page, and continuing to use the app after a revision means you accept it.

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Before filing anything, write to us at alphaintellabs@gmail.com and describe the problem; we will respond within 30 days, and most things end there. If that does not resolve it, you and we agree that the state and federal courts located in California have exclusive jurisdiction, and each of us consents to venue there.

If you are a consumer, none of that removes the protection of the mandatory consumer laws of the country or state where you live, or your right to bring proceedings there where local law gives you that right. Either of us may always bring an individual claim in small claims court.
